1. Eligibility

1. You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) and capable of forming a legally binding contract to register or participate.
2. The Platform is intended for individual, personal use only. Corporations, partnerships, and other legal entities may not create consumer accounts without our prior written consent.
3. Where local law prohibits participation in rewards programs or sweepstakes, the Services are void where restricted.

2. Account Registration and Security

1. A valid email address or third-party sign-in is required to create an account. You agree to provide accurate, current, and complete information and to keep it updated.
2. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3. We may suspend or terminate any account that shows signs of fraud, misuse, or violation of these Terms.

3. How Pocketsfull Works

1. Earning Rewards: Users can complete online surveys, install or engage with third-party offer, or perform other qualifying actions (“Activities”) to earn Points (also called “Pockets”) tracked in your account.
2. Third-Party Content: Surveys and offers are provided by independent advertisers, market researchers, and other partners (“Partners”). Pocketsfull is not responsible for the accuracy, availability, or legality of Partner content.
3. Reward Validation: Points are pending until the Partner confirms completion, which may take minutes or several days. If a Partner rejects an Activity (e.g., for quality control, duplicate submission, or fraud), the pending Points will be canceled.

4. Rewards and Redemptions

1. Redemption Options: Points may be redeemed either for (a) third-party digital gift cards or (b) in-app currency usable within participating apps—but not both for the same Activity.
2. Minimum Payout: A minimum balance may be required for redemption; thresholds are listed on the Platform and may change. Each giftcard has it own minimum.
3. No Cash Value: Points and in-app currency have no monetary value until redeemed via the Platform’s catalogue. They are not transferable, cannot be sold, and may not be combined across accounts.
4. Delivery: Electronic gift cards are ordinarily delivered by email within 1 business days. Pocketsfull is not liable for delivery failures caused by spam filters or inaccurate user information.
5. Expiration & Forfeiture: Points expire 12 months after your last account activity or upon account termination.

5. Prohibited Conduct

You agree not to:

• Use bots, scripts, VPNs, emulators, or other automated means to access the Services;
• Submit false or misleading information in surveys or offers;
• Attempt to decompile, reverse-engineer, or hack the Platform;
• Engage in any activity that interferes with or disrupts the Services or servers;
• Use the Services for commercial purposes without our written consent;
• Violate any applicable law, regulation, or third-party right.

6. Intellectual Property

All content, software, trademarks, and intellectual-property rights in the Platform are owned by Pocketsfull or its licensors. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to access and use the Services for lawful, personal, non-commercial purposes.

7. Third-Party Links and Disclaimer of Responsibility

The Platform may contain links to Partner sites or offers. Pocketsfull does not endorse or control those third-party resources and is not responsible for their content, privacy practices, or terms.
Gift-card brands, platform stores, or payment networks referenced are the property of their respective owners and are not sponsors of or affiliated with Pocketsfull.

8. Disclaimer of Warranties

THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKETSFULL DISCLAIMS ALL WARRANTIES—EXPRESS OR IMPLIED—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT GUARANTEE THAT: (A) THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY DEFECTS WILL BE CORRECTED; OR (C) YOU WILL EARN ANY SPECIFIC AMOUNT OF POINTS OR REWARDS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POCKETSFULL, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL—ARISING OUT OF OR RELATED TO THE USE OF THE PLATFORM OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US $50) OR THE VALUE OF UNREDEEMED POINTS IN YOUR ACCOUNT.
Some jurisdictions do not allow certain limitations; if prohibited, portions of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Pocketsfull and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your (a) use of the Services; (b) violation of these Terms; or (c) infringement of any third-party right.

11. Suspension, Termination, and Account Closure

1. We may suspend or terminate your account at any time—with or without notice—if we suspect fraud, abuse, or a violation of these Terms.
2. Upon termination, unused Points are forfeited and your licence to use the Services ceases.
3. You may close your account at any time by emailing help@pocketsfull.ai. Closing the account permanently deletes any unredeemed Points.

12. Modification of Terms and Services

We may modify these Terms or discontinue parts of the Services at any time. Material changes will be posted on the Platform or sent to your registered email. Continued use after the effective date constitutes acceptance.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction.
At our sole discretion, we may require you to submit any dispute to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, held in Orlando, Florida.

14. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision shall be struck and the remaining provisions remain in full force. These Terms, together with our Privacy Policy and any additional rules or guidelines posted on the Platform, constitute the entire agreement between you and Pocketsfull.
